William (Bill) C. Brown is a partner and consultant with Ardent Solutions, LLC. Bill is involved in all aspects of marketing, negotiation, compliance, design, and financial analysis of benefit programs and has over ten years experience with employee welfare and fringe benefits plans, as well as retirement plans. He has managed care experience, expertise in ASO contracts, and alternatively funded group insurance programs. Bill achieved a B.A. in economics from the University of Texas at Austin where he was also captain of the men’s soccer team. Did You Know? Exchange Model Notice Expiration Date Extended

The DOL recently extended the expiration date on its model Exchange notices under the ACA through May 31, 2020. Despite the updated expiration date, the content of the model notices has not substantively changed. The expiration date is included largely as an administrative function for the DOL and does not impact the notices’ applicability or an employer’s ability to use them. The ACA requires employers to provide the exchange notice to all new hires at the time of hiring. There is no annual requirement to provide the notice to existing employees nor is there a fine or penalty for failing to provide the notice. The IRS released most draft 2018 forms for ACA reporting under Code Sections 6055 and 6056. A 2018 draft version of Form 1095-B and draft instructions for these forms have not yet been released. IRS Issues New Tools for 2018 Tax Withholding

As of Feb. 15, 2018, employers must use new tables to determine how much income tax to withhold from their employees’ paychecks. The Internal Revenue Service (IRS) issued the required new tables, which reflect changes made by the Tax Cuts and Jobs Act, on Jan. 9, 2018. On Feb. 28, 2018, the IRS also released a revised Form W-4 and a new Withholding Calculator to reflect the changes. Spending Resolution Affects ACA Taxes

NLRB Reinstates Prior Joint Employer Standard

On Dec. 14, 2017, the National Labor Relations Board (NLRB) overruled its “indirect control” joint employer standard and reverted to the previous “direct control” standard. This NLRB decision does not require immediate action from employers. However, employers should review their current business practices and identify whether they are at risk of being considered a joint employer under the new standard.
